1.Application of the sales conditions.

1.1 All orders placed online at OJ EXCLUSIVE are governed by these sales conditions that apply to the exclusion of all other conditions. Additionally the Terms and Conditions of the website « www.oj-exclusive.com » and Dutch legal provisions and agreements in force can apply.

1.2 By placing an order, you acknowledge having read, understood and accepted, without reservation, these sales conditions.

1.3 By using this Website, you further agree to be subject to the terms and conditions that OJ EXCLUSIVE encourage you to read attentively before using the services or order products offered by OJ EXCLUSIVE.

1.4 OJ EXCLUSIVE reserves the right to modify at any time these conditions of sales by publishing on its website « www.oj-exclusive.com » a new version. Each order placed after the publication by OJ EXCLUSIVE of changes to the conditions of sales implies acceptance of these.

1.5 In case of modification of the sales conditions. The sales conditions published on the day of the order will apply.

Purpose

2.1 OJ EXCLUSIVE offers the sales of new mobile phones, with an high quality customization.

2.2 The order of one or more products does not include any phone subscription of any kind.

Registering

3.1 When registering on the website « www.oj-exclusive.com », you need to ensure that the information you provide is correct, up to date and complete.

3.2 You agree to notify OJ EXCLUSIVE of any changes in your personal data by updating them, as soon as possible, on the website « www.oj-exclusive.com ».

Password

4.1 To place an order, no password is required.

Orders

5.1 In placing an order on the website « www.oj-exclusive.com », you agree to purchase the product (s) selected in accordance with these conditions of sales.

Order confirmation

6.1 The order you place on the website « www.oj-exclusive.com » does not yet constitute a binding contract, but becomes so once you receive a confirmation email from OJ EXCLUSIVE.

6.2 OJ EXCLUSIVE reserves the right, at its discretion, to refuse an order, especially in case of insolvency.

6.3 The data recorded by OJ EXCLUSIVE when ordering constitute the proof of your contractual commitment, to the order of the selected product (s). The data recorded by the payment system constitutes proof of the financial transaction.

Price

7.1 The prices for the products you order are the prices published on « www.oj-exclusive.com » on the date of the order.

7.2 The prices are including taxes for The Netherlands. For all other countries, VAT and Customs taxes may apply.

7.3 OJ EXCLUSIVE pays for shipping of the product (s) ordered; other costs, including customs and / or import taxes are the customer’s responsibility.

Payment

8.1 The payment for an order will be due at the latest five days following the order and in any case before the ordered is shipped.

8.2 The credit card payment is due immediately. Data from your credit card is encrypted for security reasons.

Delivery

9.1 Any order confirmed by OJ EXCLUSIVE is delivered to the address indicated on the order.

9.2 OJ EXCLUSIVE is committed to do all it can to ship the order at the latest within 15 (working) days following the confirmation of payment by the bank to OJ EXCLUSIVE.

9.3, In case of force majeure, and special orders (products « tailored ») the delay of 15 days does not apply.

Goods Inspection

10.1 It is your responsibility to check carefully and diligently the quality and condition of the product, immediately upon delivery.

10.2 If you find that the goods have been damaged, it is your responsibility to notify OJ EXCLUSIVE within 7 days from the date you received the product.

10.3 It is your responsibility to return the damaged product to OJ EXCLUSIVE.

10.4 OJ EXCLUSIVE will replace the damaged product.

Revocation

11.1 You may return merchandise that does not satisfy you within 7 days from the date of receipt of the product.

11.2 OJ EXCLUSIVE only accept returns of products in good condition, unused, in their original packaging and accompanied by their invoice.

11.3 When the return conditions are met, OJ EXCLUSIVE refunds the cost of the returned product, within a maximum period of one month from the date of receipt of the returned product.

11.4 The costs arising from the right of revocation, especially shipping, import and customs costs are your responsibility. OJ EXCLUSIVE reserves the right to deduct the costs you have not paid from the refundable amount.

11.5 You are solely responsible for damages resulting from the return of (these) product (s).

11.6 The special order (products « tailored ») is not accompanied by a right of cancellation.

Warranty

12.1 OJ EXCLUSIVE offers a warranty for manufacturing defects in the cell phone for a period of one years from the date of delivery of the product.

12.2 OJ EXCLUSIVE provides a guarantee for any manufacturing defects related to the customization of the cell phone for one year from the date of delivery of the product.

12.3 In the event of default under warranty, OJ EXCLUSIVE will, have a choice between, repairing the damaged product or provide you with an identical product. These sales conditions preclude the exercise of any other warranty right.

12.4 In addition, it is your responsibility to read the literature on the product for additional warranty information of the mobile phone.

Limitation of Liability

13.1 The photos, images and texts illustrating and describing the products offered by OJ EXCLUSIVE on its website « www.oj-exclusive.com » are not binding and solely for informational purposes. OJ EXCLUSIVE assumes no responsibility for any errors, omissions or discrepancies in the pictures, images or text on the website « www.oj-exclusive.com ».

13.2 OJ EXCLUSIVE is not liable for any indirect, incidental, loss of profits or injury caused.

13.3 OJ EXCLUSIVE is not responsible for any consequences of illegal use of its products.

13.4 OJ EXCLUSIVE assumes responsibility for the good condition of the product to delivery of the order.

13.5 The general conditions of salesexc lude the guarantee in case of eviction.

13.6 The special orders (products « tailored ») will be subject to special regulations, on a case by case basis.

Language of the general sales conditions and interpretation

14.1 These conditions of sales are available in English.

14.2 Upon request and a contribution to the costs of translation, OJ EXCLUSIVE will provide a version of these general sales conditions in any desired language.

Force majeure

OJ EXCLUSIVE 1.15, in compliance with the ethics involved with its services, is committed to making every effort to meet its obligations, but cannot be held responsible for delays or failure to deliver under circumstances beyond its control such as strikes, natural disasters, wars, circumstances that prevent the production, the transport, the delivery or any other event, unpredictable and external to OJ EXCLUSIVE.

15.2 In case of delay, OJ EXCLUSIVE will fulfill its obligations as soon as possible and reserves the right to distribute the remaining stocks to its different customers, equitably.

Applicable law and jurisdiction

16.1 These conditions of sales are governed by Dutch law.

16.2 The jurisdiction is accepted and recognized by the parties as in Almelo (The Netherlands).
